P3 Network Vessel Sharing Agreement

On August 27, 2014, former parties to the P3 Network Vessel Sharing Agreement, Maersk Line and MSC Mediterranean Shipping, filed the Maersk/MSC Vessel Sharing Agreement, FMC Agreement No. 012293. The proposed agreement would authorize the parties to share vessels and engage in related cooperative working arrangements in the trades between the U.S. and Asia, North Europe, and the Mediterranean.

On September 2, 2014, parties to the P3 Network Vessel Sharing Agreement terminated their agreement on file with the Commission.

On March 24, 2014, the P3 Network Vessel Sharing Agreement filed with the Commission became effective under the 1984 Shipping Act.

On February 7, 2014, the parties to the proposed P3 Network Vessel Sharing Agreement filed a response to the Commission's December 5, 2013 Request for Additional Information (RFAI). The proposed agreement parties' filing is confidential. The Commission is in the process of reviewing the filing and determining whether the submission is substantially responsive to the Commission's request for additional information and documents.

On December 5th, 2013 FMC issued a press release announcing that it had decided to request additional information from the parties to the proposed P3 Network Vessel Sharing Agreement, FMC Agreement No. 012230. Public notice of the request was published in the Federal Register on December 11, 2013. Interested parties may submit further comments to secretary@fmc.gov by December 26, 2013.

On October 24, 2013, A. P. Moller-Maersk A/S, CMA CGM S.A. and MSC Mediterranean Shipping Company, S.A. filed the P3 Network Vessel Sharing Agreement with FMC. The proposed agreement would authorize the applicants to share vessels and engage in related cooperative operating activities in the trades between the U.S. and Asia, North Europe, and the Mediterranean.
