Household Goods and Personal Property Shipping Practices Considered by FMC
At its meeting on December 8, 2010, the Commission considered and approved for immediate action a number of recommendations contained in the Interim Report for Fact Finding Investigation No. 27. The Commission initiated this non-adjudicatory investigation on June 23, 2010, to develop a record on the nature, scope and frequency of potentially unfair, unlawful or deceptive practices in the shipping of household goods or personal property within the Commission's jurisdiction.

Hainan P O Shipping Co., Ltd,. Granted Exemption from Section 9(c) of the Shipping Act of 1984
By petition filed July 23, 2010, Hainan P O Shipping Co., Ltd. (“Hainan” or “Petitioner”) requested that the Federal Maritime Commission (“FMC” or “Commission”) exempt it from the first sentence of section 9(c) of the Shipping Act of 1984 (“Shipping Act” or “Act”), currently codified at 46 U.S.C. § 40703. Section 40703 provides that “[n]otwithstanding section 40501(e) of this title and except for service contracts, a rate, charge, classification, rule, or regulation of a controlled carrier may not be effective, without special permission of the Federal Maritime Commission, until the 30th day after publication.” 46 U.S.C. § 40703.

Vessel Capacity and Equipment Availability Report Recommends Collaborative Approaches to Develop Supply Chain Reliability Solutions

Comments of Federal Maritime Commissioner Rebecca F. Dye at the Northeast Cargo Symposium in Boston
During the economic downturn, U.S. importers, exporters, and ocean carriers, like every other sector of the global economy, faced the most significant economic challenges of at least a generation. During 2009, U.S. liner exports fell by 14 percent and imports fell by 16 percent. Freight rates plummeted as carriers laid up over 575 vessels worldwide.

As you may know, the Shipping Act of 1984 exempts common carriers from the tariff publication requirements and the service contract filing requirements of the Act when they carry “recycled metal scrap.” However, scrap metal shippers are protected by the Shipping Act’s prohibitions contained in chapter 411 of title 46, United States Code.

Ocean Carriers and Intermediaries Pay $218,750 in Agreed Penalties
The Federal Maritime Commission has executed six compromise agreements recovering a total of $218,750 in civil penalties. The agreements were reached with a vessel-operating common carrier and five ocean transportation intermediaries. The agreed penalties resulted from investigations conducted by the Commission's Area Representatives in Houston, Los Angeles, New York, South Florida, and Washington, D.C. Staff attorneys with the Commission's Bureau of Enforcement negotiated the compromise agreements. The parties settled and paid penalties, but did not admit to violations of the Shipping Act or the Commission's regulations. "These penalties reflect the continued vigilance and hard work of the Commission's Area Representatives and Bureau of Enforcement to protect the shipping public," stated Federal Maritime Commission Chairman Richard A. Yesterday the U.S. Supreme Court adopted the United States' position and solidified the legal support for through bills-of-lading, a key tool in the intermodal transportation system. FMC's 50th Anniversary
On August 12, 1961, President John F. Kennedy signed an executive order that established the Federal Maritime Commission (FMC) as an independent agency. Under the order, called Reorganization Plan No. 7, the shipping laws of the U.S. were separated into two categories: regulatory and promotional. The newly created FMC was charged with the administration of the regulatory provisions of the shipping laws.

Clarification: NVOCC Tariff Publication Requirements Unchanged Until Final Rule Issued
