On July 25, 2013, the Federal Maritime Commission (FMC) revoked Transporte Medrano, Inc. d/b/a Medrano Express’ (Medrano Express) ocean transportation intermediary license. Medrano Express is no longer authorized to provide ocean transportation services. Consumers and businesses should not tender cargo to Medrano Express or its agents for the international shipment of goods.

Direct Final Rule Request for Comments: Non-Vessel-Operating Common Carriers Negotiated Rate Arrangements; Tariff Filing Exemption
In this direct final rule, the Federal Maritime Commission is revising the regulations which govern negotiated rate arrangements. The rule eliminates some recordkeeping requirements to make them less burdensome. This rule is effective September 10, 2012 without further action, unless significant adverse comment is received by August 10, 2012.

Redesigned FMC Website Launched
On Tuesday, April 2, the Commission launched a redesigned website, www.fmc.gov. The redesign followed a process of gathering valuable input from representatives of the shipping industry, intermediaries, the public, and the media, in an effort to improve the quality, clarity, and accessibility of information that the Commission provides to the shipping public. The process also included input from each of the Commission’s offices and bureaus. In addition to a new overall graphical layout and look, the new site incorporates recommendations for a more user-friendly structure and improved navigation pathways.

This represents an increase of $1,900,000 over the enacted Fiscal Year 2012 appropriation and funds 131.6 full-time equivalent employees. It is $265,000 less than requested in the President’s budget for Fiscal Year 2012.

Final Rule for Freight Index-Based Service Contracts Released
The Federal Maritime Commission issued a final rule for freight index-based service contracts to provide flexibility and certainty to ocean carriers and their customers. The new rule makes clear that service contracts can reference freight indices or other outside terms, so long as they are readily available to the contracting parties and the Commission.

A proposed rule to update the Commission’s Rules of Practice and Procedure for pleadings, motions, and discovery in agency adjudications has been approved for publication and comment. The proposed changes are intended to add clarity, reduce burdens on parties, and incorporate standards from the current Federal Rules of Civil Procedure. This is the second proposed rule change in an ongoing initiative to make the Commission’s procedural rules more clear, modern, and efficient. Comments on the proposed rule are due by April 30, 2012

The FMC today released its Bureau of Trade Analysis’s Study of the 2008 Repeal of the Liner Conference Exemption from European Union Competition Law . The primary issue addressed in the multi-year Study is: What impact has the repeal of the liner conference block exemption in Europe had on U.S. liner trades? The Federal Maritime Commission has completed compromise agreements recovering a total of $490,000 in civil penalties. The agreements were reached with eight non-vessel-operating common carriers (NVOCCs) and with related companies. Notice of Proposed Rulemaking: Adjustment of the Amount for the Optional Rider for Proof of NVOCC Financial Responsibility for Trade with the People’s Republic of China
The Federal Maritime Commission proposes to amend its rules regarding the amount of bond coverage required in its optional China Bond Rider for Non-Vessel-Operating Common Carriers (NVOCCs). The proposed rule is intended to provide NVOCCs with the ability to post a bond with the Commission that satisfies the equivalent of 800,000 Chinese Renminbi, for which the equivalent dollar amount has fluctuated since the regulation was first adopted by the Commission. Comments due by March 12, 2012.

Eight compromise agreements recovered a total of $477,500 in civil penalties for alleged violations of the Shipping Act. The agreements were reached with ten non-vessel-operating common carriers (NVOCCs) and related companies providing ocean transportation services. The agreed penalties resulted from investigations conducted by the Commission’s Area Representatives in Los Angeles, New York, Seattle, South Florida, and Washington, D.C. Staff attorneys with the Commission’s Bureau of Enforcement negotiated the compromise agreements. The parties settled and agreed to penalties, but did not admit to violations of the Act or the Commission’s regulations.

This proceeding was initiated under section 19 of the Merchant Marine Act, 46 U.S.C. § 42101 (“Section 19”), in response to apparent unfavorable conditions in the foreign oceanborne trade between the United States and Japan. On February 26, 1997, following an extensive investigation, the Commission issued a final rule finding unfavorable conditions facing U.S. ocean shipping interests in Japanese ports. In October 2008, demand for vessel space in the U.S. trades plunged dramatically. Vessels that had been sailing 95 percent full from Asia to the United States were soon sailing 75 percent full. By petition filed July 23, 2010, Hainan P O Shipping Co., Ltd. (“Hainan” or “Petitioner”) requested that the Federal Maritime Commission (“FMC” or “Commission”) exempt it from the first sentence of section 9(c) of the Shipping Act of 1984 (“Shipping Act” or “Act”), currently codified at 46 U.S.C. § 40703. Section 40703 provides that “[n]otwithstanding section 40501(e) of this title and except for service contracts, a rate, charge, classification, rule, or regulation of a controlled carrier may not be effective, without special permission of the Federal Maritime Commission, until the 30th day after publication.” 46 U.S.C. § 40703.

Ocean Carriers and Intermediaries Pay $218,750 in Agreed Penalties
The Federal Maritime Commission has executed six compromise agreements recovering a total of $218,750 in civil penalties. The agreements were reached with a vessel-operating common carrier and five ocean transportation intermediaries. The agreed penalties resulted from investigations conducted by the Commission's Area Representatives in Houston, Los Angeles, New York, South Florida, and Washington, D.C. Staff attorneys with the Commission's Bureau of Enforcement negotiated the compromise agreements. The parties settled and paid penalties, but did not admit to violations of the Shipping Act or the Commission's regulations. "These penalties reflect the continued vigilance and hard work of the Commission's Area Representatives and Bureau of Enforcement to protect the shipping public," stated Federal Maritime Commission Chairman Richard A. The Federal Maritime Commission today announced compromise agreements recovering civil penalties in the amount of $748,000. The agreements were reached with a vessel-operating common carrier ("VOCC") and licensed and unlicensed ocean transportation intermediaries ("OTIs") (both non-vessel-operating common carriers ("NVOCCs") and ocean freight forwarders). In concluding the compromise agreements, the parties did not admit any violations of the Act or the Commission's regulations.

The Federal Maritime Commission announced that it filed in the U.S. District Court in Washington D.C. today a motion requesting the court to withdraw the Commission's challenge of FMC Agreement No. 201170, the Los Angeles/Long Beach Port Infrastructure and Environmental Programs Cooperative Working Agreement. In October 2008, the Commission authorized staff to file a complaint with the U.S. District Court pursuant to section 6(h) of the Shipping Act of 1984 to enjoin aspects of Agreement No. 201170, including concession requirements that mandated exclusive use of employee-drivers in the Port of Los Angeles.

FMC Issues Final Rule in Docket No. 04-11 Updating Existing and Adding New Filing Fees
The Federal Maritime Commission has updated existing filing fees and added a new filing fee that will become effective April 4, 2005. In adopting the updated schedule of fees, the Commission noted that current fees have been effective since 2002, and are no longer representative of the Commission's actual costs for providing such services. The Commission is establishing a separate fee for the filing of terminal exempt agreements. Currently, the Commission maintains the same filing fee for carrier and terminal exempt agreements, however terminal exempt agreements generally require less processing time; consequently, the Commission established a separate filing fee for terminal exempt agreements.​
