Statement of Chairman Richard A. Lidinsky, Jr. Regarding Consolidated Chassis Management Pool Agreement Amendment
I support Commission Staff’s recommendation and vote at this time to take no action to prevent the Amendment from becoming effective under the Shipping Act, while instructing Staff to monitor the implementation of the amended agreement through reporting requirements pursuant to the Commission’s authority set forth in 46 C.F.R. § 535.702(d).

Extension of Time to Comment in Notice of Inquiry: U.S. Inland Containerized Cargo Moving Through Canadian and Mexican Seaports
The Commission has received a request from the Shipping Federation of Canada for an extension of time until January 9, 2012, to file responses in this proceeding. The Commission has determined to grant this request. The due date for responses is therefore extended to January 9, 2012.

Comments of Federal Maritime Commissioner Rebecca F. Dye at the American Metal Market Moving Metals Conference
The Shipping Act of 1984 exempts common carriers from the tariff publication requirements and the service contract filing requirements of the Act when they carry recycled metal scrap. However, scrap metal shippers are protected by the Shipping Act’s prohibitions contained in chapter 411 of title 46, United States Code.

Michael A. Khouri Confirmed as FMC Commissioner by Senate
The United States Senate confirmed President Obama’s nomination of Michael A. Khouri on November 18, 2011 as Federal Maritime Commissioner for a term to expire on June 30, 2016. Commissioner Khouri will be sworn in for his second term as Commissioner in the next several weeks.
